What is a Trademark?

A trademark is a sign that distinguishes the goods and services of one trader from those of other traders. In general, a trademark can be words (including personal names), logos, designs, letters, characters, numbers, graphic elements, colors, sounds, smells, shapes of goods or their packaging, or any combination of these. A logo must be capable of being represented graphically in order to be registered as a trademark.

Why register a trademark?

Registering your trademark means that you have the exclusive right to use the trademark for the goods and services for which it is registered.

If other traders use it for the same or similar goods or services in Hong Kong without your consent, they may be liable for your trademark infringement and you may take legal action. If you don't register your trademark, you can still use it, but it is difficult to prove that you are the "owner" of the trademark, so your protection is limited
